The Biden Administration is backing a natural gas pipeline project in a legal fight about eminent domain that ended up in the Supreme Court, a move that shocked environmentalists who had hoped the Administration would not support any oil and gas pipeline projects.
The Department of Justice, however, backed the PennEast natural gas pipeline project in a lawsuit the Supreme Court agreed last week to hear.
PennEast is a pipeline project of 120 miles to carry natural gas from Pennsylvania to New Jersey and will meet growing energy demand in New Jersey and Pennsylvania, one of the project shareholders, Enbridge, says.
The PennEast Pipeline Company is looking to overturn a federal appeals court ruling from 2019, which said that PennEast could not use eminent domain to seize land owned by the state of New Jersey for pipeline construction.
The federal appeals court argued in 2019 that taking the New Jersey-owned land went against the 11th Amendment, which protects states from certain lawsuits.
The Supreme Court last week agreed to hear the case, and now the Biden Administration, just like the Trump Administration before that, is backing in a brief to the court the arguments of the pipeline company seeking to overturn the lower court’s ruling.
Ron Morano, executive director of Affordable Energy for New Jersey, told Bloomberg Law he hoped that the Biden Administration’s support to PennEast could “be indicative of this administration’s future positions on our energy independence.”
Environmentalists were disappointed, with Maya K. van Rossum, head of the Delaware Riverkeeper Network, telling Bloomberg Law the backing of PennEast “is an abuse of power and trust and a failure of the current administration to do its duty to protect people and our environment.”
Since taking office, President Joe Biden has killed the Keystone XL project and ordered a pause on new permits for oil and gas drilling on federal lands and in federal waters, giving environmentalists hopes that the Administration would side against any pipeline projects in the future.

They backed it because the ability to forcibly take property trumps one pipeline.
We need to remember – climate change is a religion. No matter what facts are presented, the believers will never be convinced that they are wrong. That said, I do know what will convince them and that will be the weather mid century when the approaching cool period will be obvious and their wind mills and shiny mirrors aren’t producing any electricity. What will these snowflakes do then?
The climate activists want to end the use of fossil fuels quickly and that includes blocking any expansion of their use. Even if the climate change fraud were actually true, this doesn’t make sense for natural gas. Of all fossil fuels, natural gas has the lowest emissions of carbon dioxide per unit of energy produced. Some environmentalists have even proposed using natural gas as a bridge into a lower emission future. Even if climate change were a problem, opposing natural gas does not make sense.
“Carbon” emissions are not harmful, no matter the source of CO2.
Often times it is useful to look at things from an alternate point of view. My comment was that even from the point of view of those who believe in the climate change fraud, the use of natural gas should make sense.
As far as myself, I’m very well aware that carbon dioxide emissions are not harmful. I know that higher levels of carbon dioxide in the atmosphere are beneficial such as the greening of the earth.
It is doubtful that mankind’s emissions have much of an impact. Yes, since we have been emitting CO2 as the industrial revolution started, atmospheric CO2 levels have gone up, but this is most likely a case were correlation does not mean causation. Of all of the CO2 released each year, man’s portion is some where around 2% to 4%. Most people should find it hard to believe that percentage is responsible for the changes we have seen.
The earth has been naturally warming since the mini ice-age. The oceans contain 20 times as much carbon dioxide as the atmosphere. It is basic physics that as water is warmed it can hold less dissolved gasses. This has to be a contributor to the increase in CO2.
Also consider the “sea” of soil that covers the earth. The warmer it is the faster the metabolic rate of the bacteria. This will alter the balance as far as how much carbon remains in the organic compounds and how much is released as CO2.
The real pollution is all of the baseless claims that the climate change movement is founded on.
In the 10th century there was global warming as they call it when the Vikings discovered a green island near the Artic circle and called it Greenland and is almost permently covered in ice and in 1912 the Artic was melting and a huge iceberg broke away and sank the Titanic . This is nothing new as it is shown on the webb at Milinkovitch cycles and the earths tilting axis controls climate so our governments are up to their necks peddling this socialist scam to get a world tax for the UN which controls our governments who do not work for their people but the berueacrats in the UN .
